Partner Visa Migration Pathway

STAGE 1: PROVISIONAL VISA

There are things that we need to consider before pursuing a Partner Visa. See the details below and let us check your eligibility to have a Partner Visa.

ONSHORE

Subclass 820 Partner (Temporary) Visa

It allows the de facto partner or spouse of an Australian citizen, a permanent resident or eligible New Zealand citizen to live temporarily in Australia. This visa is the first step in getting a Partner (Permanent) visa (Subclass 801).

OFFSHORE

Subclass 300 Prospective Marriage Visa (PMV)

It allows the applicant to travel Australia to marry their prospective spouse, then may apply for a Partner visa.

Subclass 309 Partner Provisional Visa

It allows the de facto partner or spouse of an Australian citizen, a permanent resident or eligible New Zealand citizen to live temporarily in Australia. This visa is the first step in getting a Partner (Permanent) visa (Subclass 100).

Whether you are onshore or offshore, you may still apply for a Partner Visa. However, you need consider your circumstances. For onshore, your partner must be in Australia first. While for offshore, you can process your visa application apart from each other until the finalization of Stage 1: Provisionary Visa.

STAGE 2: PERMANENT VISA

ONSHORE

Subclass 801 Partner (Permanent) Visa

It allows the de facto partner or spouse of an Australian citizen, a permanent resident or eligible New Zealand citizen to live in Australia permanently. This visa is usually granted to people who are holding a temporary Partner visa (Subclass 820).

OFFSHORE

Subclass 100 Partner (Migrant) Visa

It allows the de facto partner or spouse of an Australian citizen, a permanent resident or eligible New Zealand citizen to live permanently in Australia. This visa is usually granted to people who are holding a temporary Partner visa (Subclass 309).

The partner who is approved in Stage 2: Permanent Visa is allowed to permanently live in Australia.

 

Also, dependent children of the partner visa or PMV applicant can be included to the visa application,

or can apply for Australian visa once the partner visa application is finalised.
