Subclass 820

Partner (Temporary) Visa

It allows the de facto partner or spouse of an Australian citizen, a permanent resident or   eligible New Zealand citizen to live in Australia while waiting for the decision form Partner    Permanent visa. This visa is the first step in getting a Partner (Permanent) visa (Subclass 801).

Partner (Temporary) Visa Requirements

  • The applicant must in a genuine and continuing relationship with their de facto partner or spouse who is an Australian citizen, a permanent resident or eligible New Zealand citizen.
  • The applicant must be in Australia when applying for the visa and when the Department of Home Affairs decides on the Partner (Temporary) visa application. Furthermore, the migrating family of the applicant must be in Australia too.

How much it will cost

The visa (government) fee starts from AUD7,850. For Prospective Marriage visa (Subclass 300) holders, it begins from AUD1,310.

The applicant may pay both the Partner (Provisional) visa and Partner (Permanent) visa at the same time.

Stay duration

The visa holder can stay in Australia while the Department of Home Affairs is processing the Partner visa Permanent (Subclass 801) application or decided.

Processing time

On average, the processing time takes 23 to 30 months depending on the circumstances of the Partner (Provisional) visa application.

Being Partner (Temporary) Visa holder

The partner who is granted is alowed to:

  • Live, study and work in Australia while the Department of Home Affairs is processing the Partner (Permanent) visa application
  • Enjoy traveling to and from Australia as many times as you want
  • Participate in free English language classes provided by the Adult Migrant English Program
  • Sponsor dependent child up below 25 years of age to join in Australia

Subclass 801

Partner (Permanent) Visa

It allows the de facto partner or spouse of an Australian citizen, a permanent resident or eligible New Zealand citizen to live in Australia permanently. This visa is usually granted to people who are holding a temporary Partner visa (Subclass 820).

Partner (Permanent) Visa Requirements

  • The applicant must hold a Partner (Temporary) visa (Subclass 820).
  • In some cases, the applicant continues the marries or de facto relationship with their sponsor.
  • Must demonstrate since approval of Partner (Temporary) visa the applicant is still ongoing and genuine de facto or spousal relationship with the sponsor (exemption may apply)

How much it will cost

The applicant must pay all the required fees when the application for both provisional and permanent Partner visa is ready for submission to the immigration.

The partner can live indefinitely in Australia as the Partner (Permanent) visa refers to a permanent visa.

The partner who is granted is alowed to:

  • Live, study and work in Australia indefinitely
  • May sponsor relatives who are overseas to visit Australia
  • May apply for Australian citizenship when requirements (eg. residency) are met
  • Sponsor dependent child up below 25 years of age to join in Australia permanently
  • Sponsor close relative to migrate in Australia under General Skilled Migration (GSM) program
