Statutory Declaration authorization

Fortifying its aim to strengthen the Statutory Declaration for immigration purposes as part of the visa applications, the Attorney General’s Department is hereby allowing the Registered Migration Agents to authorize or witness a Commonwealth Statutory Declaration as being part of the minor amendments to ensure the regulations remain fit for purpose and meet the needs of the community.

What is Statutory Declaration?

In accordance to www.ag.gov.au, Commonwealth Statutory Declaration (SD) is a written statement which you sign and declare to be true before an authorized witness. It should be truthful and accurate to ensure that this is valid on the grounds of being impartial.

Moreover, the SD will help you to provide a legal and necessary document in supporting your claim to give evidences in most other situations.

How to write a Statutory Declaration

In writing the declaration, it includes specificially your Full Name, Address, Occupation, and a statement that you “do solemnly and sincerely declare.”.

Furthermore, once you are done with stating the above listed items, you must write the facts that you want to declare are true. And you will do this by:

Putting each evidences in distinct paragraphs

Putting the paragraph in date (chronological) order

Finish with a statement that you “make this solemn declaration conscientiously believing the same to be true and by the virtue of the provisions of the Oaths Act 1900.”

Use of Statutory Declaration

These are generally used to legalize a document when there is no such evidence is available. Likewise, it is commonly used in legally proving names, addresses and as an evidence to support such claims. 

Moreover, company directors also use statutory declarations in declaring solvency when going into voluntary liquidation.
