It allows the de facto partner or spouse of an Australian citizen, a permanent resident or eligible New Zealand citizen to live in Australia while waiting for the decision for Partner Permanent visa. This visa is the first step in getting a Partner (Permanent) visa (Subclass 100).

Partner (Provisional) Visa Requirements
- The applicant must in a genuine and continuing relationship with their de facto partner or spouse who is an Australian citizen, a permanent resident or eligible New Zealand citizen.
- The applicant must be outside Australia when applying for the visa and when the Department of Home Affairs decides on the Partner (Temporary) visa application.

Stay duration
The visa holder can stay in Australia while the Department of Home Affairs is processing the Partner visa Permanent (Subclass 100) application or decided.

On average, the processing time takes 15 to 29 months depending on the circumstances of the Partner’s Provisional visa application.
These are some reasons why the process is taking longer than usual:
- The information in the application are not complete
- The supporting documents are not sufficient for the case officer to finalise the application and more document(s)/information are required
- The response time of the applicant for the requested information
- The information provided takes time on the verification process.
- The information from external agencies sometimes takes time. Example, those who are related to national security, health, and character requirements
- Number of applications load process by the processing centre, internal policy (processing standard time) and influx in application in a given time period

Being Partner (Provisional) Visa holder

- Live, study and work in Australia while the Department of Home Affairs is processing the Partner visa (Permanent) application

- Participate in free English Language classes provided by the Adult Migrant English Program
- Sponsor dependent child below 25 years of age to join in Australia

Subclass 100
Partner (Migrant) Visa
It allows the de facto partner or spouse of an Australian citizen, a permanent resident or eligible New Zealand citizen to live permanently in Australia. This visa is usually granted to a temporary Partner visa (Subclass 309) holders.
Partner (Migrant) Visa Requirements
- In some cases, the applicant must hold a temporary Partner (Provisional) visa (Subclass 309).
- In some cases, the applicant must continue the relationship genuinely with their partner.
- Must demonstrate since approval of Partner (Temporary) visa the applicant is still ongoing and genuine de facto or spousal relationship with the sponsor (exemption may apply)

The applicant must pay all the required fees when the application for both temporary and permanent Partner visa is ready for submission to the immigration.
Stay duration
The partner can stay indefinitely in Australia as the Partner (Migrant) visa refers to a permanent visa.
Processing time
On average, the processing time takes 20 to 29 months depending on the circumstances of the Partner Migrant visa application.
Partner (Migrant) Visa holder
The partner who is granted is alowed to:
- Live, study and work in Australia indefinitely
- May sponsor relatives who are overseas to visit Australia
- May apply for Australian citizenship when requirements (eg. residency) are met
Subclass 300
Prospective Marriage Visa
It allows the applicant to visit Australia to marry their prospective spouse, then may apply for a Partner visa.
Prospective Marriage Visa Requirements
- Applicant must be 18 years old or above.
- Applicant must be sponsored by an Australian citizen or a permanent resident.
- Applicant must express the intention to marry the prospective spouse before the visa application ends.
How much it will cost
The visa (government) fee starts from AUD8,850.
Stay duration
The partner can stay in Australia for nine months from the date the visa is granted.
Processing time
On average, the processing time takes 17 to 35 months depending on the circumstances of the Prospective Marriage visa application.
Being Prospective Marriage Visa holder
The partner who is granted is alowed to:
- Live in Australia for nine months from the date the visa is granted
- Work in Australia
- Study in Australia at the applicant’s expense
