Prospective Marriage Visa Requirements
- The applicant must be 18 years old or above.
- Applicant must be sponsored by an Australian citizen or a permanent resident or eligible New Zealand Citizen
- Applicant must express the intention to marry the prospective spouse before the visa application ends.
- The applicant and sponsor must meet in person

Stay duration
The partner can stay in Australia for 9 and 15 months from the date the visa is granted.
Processing Time
On average, the processing time takes 25 to 34 months depending on the circumstances of the Prospective Marriage visa application.
These are some reasons why the process is taking longer than usual:
- The information in the application are not complete
- The supporting documents are not sufficient for the case officer to finalise the application and more document(s)/information are required
- The response time of the applicant for the requested information
- The information provided takes time on the verification process.
- The information from external agencies sometimes takes time. Example, those who are related to national security, health, and character requirements
- Number of applications load process by the processing centre, internal policy (processing standard time) and influx in application in a given time period
Being Prospective Marriage Visa holder
The partner who is granted is allowed to:
- Live in Australia for nine months from the date the visa is granted
- Study in Australia at the applicant’s expense
- Work in Australia
- Enjoy travelling to and from Australia as frequent as you want
Continuing the Prospective Marriage visa to Partner visa.
If the Department of Home Affairs grants your visa, you and your spouse can apply for Partner (Temporary and Permanent) visa (Subclass 820 and 801) to settle in Australia.
Application process during the Prospective Marriage visa application to Partner visa (Subclass 820 and 801)
- After your wedding, and
- before your Prospective Marriage visa ends
The applicant will pay less for the Partner visa application if she/he applies for it while the Prospective Marriage visa (Subclass 300) is still valid.

Subclass 100
Partner (Migrant) Visa
It allows the de facto partner or spouse of an Australian citizen, a permanent resident or eligible New Zealand citizen to live permanently in Australia. This visa is usually granted to people who are holding a temporary Partner visa (Subclass 309).
Partner (Migrant) Visa Requirements
- In some cases, the applicant must hold a temporary Partner (Provisional) visa (Subclass 309).
- In some cases, the applicant must continue the relationship genuinely with their partner.
How much it will cost
The applicant already paid the fees when the application for temporary and permanent Partner visa were made.
Stay duration
The partner can stay indefinitely in Australia as the Partner (Migrant) visa refers to a permanent visa.
Processing time
Usually, the processing takes 19 to 27 months depending on the circumstances of the Partner’s (Migrant) visa application.
Being Partner (Migrant) Visa holder
- Live, study and work in Australia indefinitely
- Sponsor eligible family members who are overseas to visit Australia
- Apply for Australian citizenship if eligible
Subclass 309
Partner (Provisional) Visa
It allows the de facto partner or spouse of an Australian citizen, a permanent resident or eligible New Zealand citizen to live temporarily in Australia. This visa is the first step in getting a Partner (Permanent) visa (Subclass 100).
Partner (Provisional) Visa Requirements
- The applicant must have a real relationship with their de facto partner or spouse who is an Australian citizen, a permanent resident or eligible New Zealand citizen.
- The applicant usually needs to be outside Australia when applying for the visa and when it is granted.
How much it will cost
The processing fees start from AUD7,850.
Stay duration
The partner can stay temporarily until the Department of Home Affairs decides for the permanent Partner visa (Subclass 100) application or the application is withdrawn.
Processing time
Usually, the processing takes 21 to 28 months depending on the circumstances of the Partner’s (Provisional) visa application.

- Live, study and work in Australia while the Department of Home Affairs is processing the Partner (Permanent) visa application
- Enjoy traveling to and from Australia
- Participate in free English language classes provided by the Adult Migrant English Program
